Federal Judge Rules Colorado Gay Marriage Ban Unconstitutional

A federal judge ruled Colorado's ban on same-sex marriage is unconstitutional but stayed implementation of his ruling until a higher court can weigh in, leaving the fate of couples who have continued to obtain marriage licenses up in the air.

The judge's ruling Wednesday came in the case of six same-sex couples who sued over the state's Constitutional ban on gay marriage.

"As previously discussed, on the state of the record currently before the court, it is plaintiffs who have shown a likelihood of success on the merits; it is plaintiffs who suffer irreparable harm if Colorado's unconstitutional same-sex marriage ban is not enjoined; and it is plaintiffs to whom the balance of harm and the public interest favor," Judge Raymond Moore wrote in his order.

A higher federal court earlier last month ruled Utah's similar ban unconstitutional, and several Colorado county clerks began issuing marriage licenses to gay and lesbian couples, arguing that ruling applied to Colorado.

Colorado Attorney General John Suthers has repeatedly asked federal courts to clarify the situation, saying the piecemeal approach across the state is creating "chaos" over whether the licenses issued to same-sex couples are legally valid.

Suthers persuaded county clerks in Denver and Pueblo to stop issuing licenses to same-sex couples, but Boulder County Clerk Hillary Hall has continued to grant them. Neither Hall nor Suthers could immediately be reached Wednesday afternoon.

"Judge Moore did the right thing today, faithfully upholding both the Constitution and Colorado values," Evan Wolfson, president of Freedom to Marry, said in a statement. "This is the second court decision in favor of the freedom to marry just in Colorado -- and across the country, judge after judge, court after court, in state after state have all examined the evidence and sifted through the arguments and concluded that the denial of marriage to same-sex couples cannot stand. It's time for the state attorney general to stop spending taxpayer money to defend the indefensible and allow gay couples to wed now."

Moore stayed implementation of his order striking down the state's ban until Aug. 24, giving the state time to appeal to either the 10th Circuit Court of Appeals or the U.S. Supreme Court.

 

Colorado AG John Suthers Appeals Gay Marriage Ruling

Colorado Attorney General John Suthers has appealed a federal judge's ruling striking down Colorado's ban on gay marriage.

U.S. District Judge Raymond P. Moore on Wednesday declared the ban invalid but stayed the ruling until Monday, August 25.

Suthers, a Republican, did not oppose the injunction but asked Moore to delay implementation until the Supreme Court has ruled in a separate case challenging Utah's ban.

Suthers' office filed a notice of appeal to the Tenth Circuit Court of Appeals in Denver shortly after Moore handed down his ruling.

“We are gratified Judge Moore agreed with us that additional litigation in that court would be wasteful given that our laws' status will be decided by the Supreme Court's decision in the Utah case,” Suthers said in a statement.

While the Utah case was the first appealed to the Supreme Court, dozens of cases from across the country are wending their way through federal courts. The high court is not required to take any case.

The Tenth Circuit's decision in the Utah case prompted plaintiffs – six gay and lesbian couples – to challenge Colorado's ban.

I know someone that has mentioned suicide, what do I do now?

 

There are many reasons why someone considers suicide:

  • Relationship break-ups
  • Family problems
  • Sexual, physical or emotional abuse
  • Drug or alcohol problems
  • Mental illness, including schizophrenia, bipolar disorder and depression
  • Major loss and grief such as a death or the suicide of a friend, family member, public figure
  • School or work problems
  • Unemployment or being unemployed for a long time
  • Feeling like they don't belong anywhere
  • Financial or legal problems
  • Any problem that they can't see a solution for

Almost everyone who takes their own life gives some clue or warning. Never ignore suicide threats. Take people’s suicidal thoughts and feelings very seriously and help them find effective help.

 

Warning signs of suicide:

  • Hopelessness 
  • Rage, uncontrolled anger, seeking revenge 
  • Acting reckless or engaging in risky activities, seemingly without thinking 
  • Feeling trapped - like there’s no way out 
  • Increased alcohol or drug use 
  • Withdrawing from friends, family and society 
  • Anxiety, agitation, unable to sleep or sleeping all the time
  • Giving away possessions
  • Marked decrease in activities or performance

 

What can you do?

Be available to listen and talk. Show and say that you care about them.

Don’t be afraid to ask the person directly about suicide. You will not be putting thoughts into their head or causing them to want to commit suicide — confronting it head on is the best thing you can do. Don't appear shocked or scared if they tell you and certainly do not argue about the morality of suicide. Ask the question directly “Are you thinking about hurting yourself?”

Do not guilt them into stopping, show compassion.

If you decide that the situation is serious enough and that the person has a plan and the means to execute the plan, do not leave the person alone unless you feel that you are physically threatened.

Call the suicide hotline 1-800-273-TALK(8255), nearest hospital emergency room, or 911.

Talk about what you can do together to keep them safe. Do not agree to keep it a secret; you should not be the only one supporting this person. You may need help from someone else to persuade them to get help.

Encourage the person to seek professional guidance. If they refuse help, contact someone in authority immediately — an angry friend is better than a dead one. Maintain contact with the person until help is secured.

Thoughts of suicide can return, so ask them to promise to reach out and tell someone. Asking them to promise makes it more likely they will tell someone and let them know they are not alone.

 

Questions to ask someone you suspect is suicidal

1. Are you going to harm yourself?

2. Do you have a plan to die by suicide?

3. How are you going to do it?

4. When/where are you going to do it?

5. Is this method available to you? (The more complete the plan the more likely the person is to act upon it.)

6. What is the pain you are experiencing like? Can we find ways to ease the pain?

7. Are there times when the pain is not so bad? How do you feel then?

8. Do you have anyone, anything that you can call upon to help you?

9. Have you attempted suicide before?

10. Are you seeing your doctor or mental health worker regularly and often?

11. What happened that made you start feeling this way?

12. How can I best help you right now?

A word on cutting

Some people cut or otherwise hurt themselves when they feel overwhelmed by difficult or stressful feelings, or to relieve their inner tension. Many people who cut themselves never attempt to kill themselves. However, in some cases, self-harm is the first indication that someone may be at risk for suicidal behavior. Whether or not they feel an impulse to take their own lives, someone who is cutting or otherwise hurting themselves needs help. Health and mental health professionals are trained to determine whether a person is at risk for suicide, and to suggest a treatment plan to help them with their self-harm behavior and underlying feelings.

About Our Hosts

Marlene Milner is a Transpersonal Emotional Healing Coach who has worked with and learned from leaders in the recovery field including, John Bradshaw, Pia Mellody, Claudia Black and Patrick Carnes.  Prior to developing her practice, Marlene was an addiction counselor at a top level inpatient treatment facility in Arizona, where she worked with celebrity clients from around the world.  

After assisting a variety of people make life -changing recoveries, Marlene discovered that her clients' biggest challenge, in addition to sobriety, was to heal the emotional self and "get comfortable in their own skin".  It's from this knowledge that Marlene created "BEYOND 12 STEP".

Jack Danielsen is the owner of Dimensions Spa in Colorado Springs, Colorado. Jack grew up in Tulsa, OK and was raised by the child of a Christian minister. Jack was ordained in the non-denominational church and worked in prison ministry and also performed marriages as a part of the marriage process Jack was required to perform pre-marital counselling using the "Saving your marriage before it starts series. Jack has been in a 5 year relationship with his lifepartner. Jack also serves on the Colorado Springs Pride board of directors and has taken a proactive role in the battle for equal rights.
